Lawsuit filed by Jack in the Box against FTX for allegedly copying its mascot, drops

Jack in the Box and FTX have reached an undisclosed settlement over the mascot-related copyright complaint.

On Jan. 20, the couple informed the District Court for the Southern District of California that they had settled the issue through a motion to dismiss, but the specifics of the settlement have not been revealed. The iconic fast food company originally filed the lawsuit in early November, stating that FTX US’s “Moon Man” character was a rip-off of Jack in the Box’s “Jack” mascot, which has trademark rights dating back to 1995.

Initially, Jack in the Box sought unspecified damages for copyright infringement, trademark dilution, trademark infringement, false designation of origin, and unfair competition.

“Rather than using its immense financial resources in developing its own intellectual property, FTX blatantly and unlawfully copied or derived its ‘Moon Man’ mascot from JITB’s Jack,” according to court documents filed in November by the firm.
